1. Platform Nature

MyRooms operates under Eva Tech Solutions and acts solely as an intermediary technology platform connecting property owners, agents, and seekers across India. We do not own, control, guarantee, or legally verify listed properties. We are not a party to rental or lease agreements.

2. Owner & Agent Responsibilities

• Provide accurate and lawful information.
• List only legally owned or authorized properties.
• Not upload false, misleading, illegal, or discriminatory content.
• Not misuse, scrape, or automate access to the platform.

3. Verification Disclaimer

Owner or agent verification, if conducted, is limited to basic manual or video-based review and does not constitute legal validation or guarantee of property authenticity.

4. Paid Listings, Boosting & Refund Policy

Paid listings, featured listings, and boosting services may be offered.

• Refund requests made on the same day of purchase may be considered with applicable deductions.
• No refund will be issued once the service duration has commenced beyond the same day.
• Completed or partially consumed promotional services are non-refundable.

5. Agent Commission Policy

Agent commission is determined based on property type, location, rent value, and listing value to the platform. The commission structure decided by MyRooms is final and non-negotiable.

6. Advertisements

The platform may display third-party advertisements and local promotional banners. We are not responsible for external websites, advertiser claims, or third-party services. Advertisement impressions and clicks may be tracked for analytics and billing purposes.

7. Fraud & Dispute Responsibility

Users are solely responsible for conducting due diligence before entering into property transactions. In case of fraud or dispute, MyRooms may assist authorities if legally required but shall not be held responsible for losses arising from user interactions.

8. Intellectual Property

All platform design, branding, source code, and system architecture belong to Eva Tech Solutions. Users retain ownership of their uploaded content but grant MyRooms a non-exclusive license to display and promote listings on the platform.

9. Account Suspension & Termination

We reserve the right to suspend, restrict, or terminate accounts or remove listings at our discretion if policies are violated.

10. Limitation of Liability

To the maximum extent permitted by law, MyRooms shall not be liable for indirect, incidental, special, or consequential damages arising from platform use.

11. Indemnification

Users agree to indemnify and hold harmless MyRooms and Eva Tech Solutions from claims arising due to misuse, false listings, or legal violations.

12. Arbitration & Governing Law

Any dispute shall first be resolved through arbitration under the Arbitration and Conciliation Act, 1996. Arbitration shall take place in Raipur, Chhattisgarh, India, conducted in English. Courts in Raipur shall have exclusive jurisdiction.

13. Force Majeure

We shall not be liable for delays or failures caused by events beyond reasonable control including natural disasters, internet outages, or government actions.

14. Severability

If any provision is found unenforceable, remaining provisions shall remain valid.

15. Entire Agreement

These Terms constitute the entire agreement between users and MyRooms.

Privacy Policy

3. Data Sharing

We do not sell personal data. Data may be shared with hosting providers, payment processors, analytics tools, advertising partners, or legal authorities if required.

4. Data Retention & Deletion

Users may request account deletion. Upon request, a 30-day review period applies. After completion of 30 days, data may be permanently removed unless legally required to retain it.

5. Cookies & Tracking

Cookies and tracking technologies may be used for authentication, analytics, and advertising performance measurement.

6. Security Measures

We implement password hashing, access control mechanisms, and technical safeguards to protect data.

7. Policy Updates

We reserve the right to modify these Terms and Privacy Policy at any time. Updated versions will be published with a revised effective date.
